Sec. 13-101 Standard Traffic Ordinance.
There is hereby adopted
and incorporated by reference for the purpose of regulating traffic within the
corporate limits of the City of Ottawa, Kansas, that certain traffic ordinance
known as the “Standard Traffic Ordinance for Kansas Cities”, Edition of 2001,
prepared and published in book form by the League of Kansas Municipalities,
Topeka, Kansas, save and except such articles, sections, parts or portions as
are hereafter omitted, deleted, modified, or changed. No fewer than three (3) copies of the
Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted
by Ordinance No. 3371-01 with all sections or portions thereof intended to be
omitted or changed clearly marked to show any such omission or change and to
which shall be attached a copy of such adopting ordinance, and filed with the
City Clerk to be open to inspection and available to the public at all
reasonable hours. The Police Department,
Municipal Judge and all administrative departments of the City charged with
enforcement of the Ordinance shall be supplied, at the City’s expense, such
number of official copies of such Standard Traffic Ordinance similarly marked,
as may be deemed expedient.

Sec. 13-102 Traffic infractions and traffic
offenses.
A. An ordinance traffic infraction is a
violation of any section of this article that prescribes or requires the same
behavior as that prescribed or required by a statutory provision that is
classified as a traffic infraction in K.S.A. 8-2118.
B. All traffic violations which are
included within this article, and which are not ordinance traffic infractions,
as defined in subsection (A) of this section, shall be considered traffic
offenses.

Sec. 13-103 Careless Driving.
It shall be unlawful for
any person to drive, operate, halt or attempt to operate a vehicle upon the
streets, highways or alleys of the City in a careless, heedless, or inattentive
manner, or without due regard or caution or circumspection, or in a manner not
constituting the degree of reckless driving, but so as to endanger any person
or property. The fine for violation of
this ordinance shall be not less than forty dollars ($40.00) nor more than six
hundred ($600.00).

Sec. 13-104 Limited time parking zones; penalties.
A. Whenever any appropriate sign shall
be placed and maintained in any block by lawful authority of the City giving
notice that the street or highway or City-owned parking lot may be used for
parking or standing vehicles for a limited time only, it shall be unlawful for
any person to fail or refuse to comply with such sign.
B. Violation of subsection (A) shall be
punishable by a fine of not less than three dollars ($3.00) and not more than
twenty-five dollars ($25.00).

Sec. 13-105 Severability.
If any provision of this
code is declared unconstitutional, or the application thereof to any person or
circumstance is held invalid, the constitutionality of the remainder of the
code and the applicability thereof to other persons and circumstances shall not
be affected thereby.

Sec. 13-107 Penalty for scheduled fines.
The fine for violation
of an ordinance infraction traffic or any other traffic offense for which the
Municipal Judge establishes a fine in a fine schedule shall not be less than
forty dollars ($40.00) nor more than six hundred dollars ($600.00). A person tried and convicted for violation of
an ordinance traffic infraction or other traffic offense for which a fine has
been established in a schedule of fines shall pay a fine fixed by the court not
to exceed six hundred dollars ($600.00).

ARTICLE II.
LOCAL REGULATIONS
Sec. 13-200 Bicycle,
unlicensed motorized vehicle or skateboard riding and roller skating prohibited
in downtown business district; exception; penalty
A. It shall be unlawful to operate the
following on the City sidewalks, as defined in this ordinance:
1.
Bicycles;
2.
Skateboards;
3. Roller skates or similar devises;
4. Unlicensed motorized vehicles;
5. Vehicles similar to a bicycle,
skateboard, roller skates, or unlicensed motorized vehicles.
B. The above prohibition does not apply to the following:
1. Children under 13 years of age when supervised by a parent or guardian so long as the child is operating a bicycle, skateboard or roller skates, or similar device.
2. Law enforcement officers on official business may operate any vehicle they deem appropriate.
C. For the purposes of the above
prohibition, the downtown business district is defined as follows.
1. The west side of Cedar St. to the
east side of Walnut St., the south side of 5th St. to the north side
of the Marais Des Cygnes River.
D. Violation of this section is a misdemeanor, punishable by a fine not to exceed $100.00.

Sec. 13-201 Unauthorized vehicle on flood
protection project.
It
shall be unlawful for any person to drive or operate an unauthorized motor
vehicle upon the levee system of the flood protection project within the City.

Sec. 13-202 Speed of railroad trains.
It
shall be unlawful for any person to operate any railroad train, engine or car
upon, along or across any street, alley or ground within the corporate limits
of the City at a speed greater than twenty (20) miles per hour.

Sec. 13-204 Pick-up,
delivery and service access permitted.
This shall not apply to
any truck when on the most accessible route to/from a pick-up or delivery, or
to provide a service at a specific location.
No truck shall remain in a location not designated as a truck route for
pick-up, delivery or service access for a period longer than two (2) hours.
Sec. 13-205 Truck
parking not permitted in Central Business District.
Truck parking shall not
be permitted in the Central Business District (CBD). This prohibition includes
trailers/semi-trailers, garage service cars, tractors, farm
implement/machinery, and vehicles for sale (new or used). This parking
prohibition shall not apply to vehicles actively engaged in loading/unloading. Exceptions to this section may be granted by
the Chief of Police or designate when justified (e.g. moving vans
loading/unloading, etc.).

A. For the purpose of establishing
maximum speed limits other than those specified for districts or locations by

B. When Work Zones are established
within public rights-of-way, the City shall have the authority to establish a
20 mph speed limit within the Work Zone.
A Work Zone Speed Limit shall be established by posting signs. Any driver in violation of the 20 mph speed
limit in a Work Zone shall be fined in an amount equal to double the normal
fine, with a minimum of fifty dollars ($50) in addition to any other fine(s)
that may result from the violation.
C. The maximum speed limit for alleys
within the area defined as the Central Business District shall be ten miles per
hour (10 mph). The Central Business
District is defined in Sec. 13-106 of the Ottawa Municipal Code.
D. Appropriate signs shall be installed
and maintained for above stated restrictions.

Sec. 13-212 Through streets designated.
In
order to establish right-of-way, streets herein are designated as through

ARTICLE
III. PARKING
Sec. 13-300 Parking
stall lines.
A.
In
cases where parking stalls in the Central Business District are marked by
lines, no part of any parked vehicle shall extend over or beyond the lines
designating a single parking stall. This
includes front (curb), both sides and rear lines indicated by the marked
stall. Parking vehicles with wheels on
the curb or sidewalk is not permitted.
B.
Exceptions to parking within lines designating spaces may apply to
vehicles parked at private driveways where bay doors exist when such vehicle
displays a permit on the rear-view mirror. Such permits will be issued in
a manner prescribed by the office of the City Clerk. Should such parking
at bay door entrances occur, the use of that space shall comply with adjoining
marked spaces with respect to extension into traveling lanes of the street, and
shall not cross or impede pedestrian movements on the sidewalks.

A. Prohibited
parking area, penalty. It shall be
unlawful for any person to park, store or otherwise cause to be placed a motor
vehicle upon terraces not specifically designed or authorized by the commission
for the parking or storage of motor vehicles.
Any person who shall violate any of the provisions of this section or
who shall aid, abet or assist in the violation of any of the provisions of this
section shall be determined guilty of a Class C misdemeanor. Each day such violation is committed or
permitted to continue shall constitute a separate offense and shall be
punishable as set forth in this section.
B. Definitions. As used in this section:
Motor vehicle-means
every vehicle which is self-propelled.
Terrace-includes,
but shall not be limited to, that portion of a public way, street or alley
within the dedicated right-of-way between the curbline or line of normal use
and the property line of the abutting owner, except for that portion used as a
driveway (as evidenced by the appropriate curb cut or entrance from street or
alley), provided that the used portion of such driveway does not block or deter
the use of the sidewalk.

Sec. 13-304 Truck and other parking prohibited in
certain areas.
No recreational vehicle,
trailer or semi trailer, tractor, farm implement or machinery, road maintenance
machinery, automobile dealer’s vehicles, or used vehicle for sale shall be
parked on streets designated below, provided that this Section shall not apply
to any vehicle described in this Section when it is actually engaged in loading
or unloading.

Sec. 13-305 Special parking regulations for
certain road conditions; removal of vehicles in violation.
A. During times when at least a
two-inch (2”) snowfall has been realized or accumulated within the City, the
Director of Public Works or his designee may order that no vehicle parking
shall be permitted upon the streets described in this subsection for a
reasonable period of time during which such regulations are necessary to
provide for efficient traffic flow:

B. During times when at least a six-inch
(6”) snowfall has been realized or accumulated within the City, the Director of
Public Works or his designee may order that no vehicle parking shall be
permitted upon the streets described in this subsection in addition to those
areas described in subsection (A) for a reasonable period of time during which
such regulations are necessary to provide for efficient traffic flow:

municipal parking lots.
C. Any order prohibiting certain
vehicle parking made pursuant to this section shall be made in writing and
shall not remain in effect for more than forty-eight (48) hours, unless such
order is specifically extended by subsequent order of the Director of Public
Works.
D. In addition to the other provisions
contained in this article, any vehicle parked upon a street described in
subsections (A) or (B) of this section in violation of any order of the
Director of Public Works or his designee as provided in this section may be
removed or caused to be removed by the Police Department, and the owner of such
vehicle shall be responsible for the expense of such removal.

Sec. 13-306 Citation for illegally parked,
standing or stopped vehicle.
Whenever any motor
vehicle without driver is found parked, standing or stopped in violation of
this article or any ordinance, the officer finding such vehicle shall take its
registration number and may take any other information displayed on the vehicle
which may identify its user, and shall conspicuously affix to such vehicle a
traffic citation.

Sec. 13-307 Failure to
appear; notice.
If a violator of this
article’s restrictions on stopping, standing or parking does not appear in
response to a traffic citation affixed to such motor vehicle within a period of
five (5) days, the Clerk of the Court shall send to the owner of the motor
vehicle to which the traffic citation was affixed a letter informing the owner
of the violation and warning that if such letter is disregarded for a period of
five (5) days a warrant of arrest will be issued.

Sec. 13-308 Prosecution; presumption of ownership.
A. In any prosecution charging a violation
of any law or regulation governing the stopping, standing or parking of a
vehicle, proof that the particular vehicle described in the complaint was in
violation of any such law or regulation, together with proof that the defendant
named in the complaint was at the time of the violation the registered owner of
such vehicle, shall constitute in evidence a prima facie presumption that the
registered owner of such vehicle was the person who parked or placed such
vehicle at the point where, and for the time during which, such violation
occurred.
B. The presumption stated in subsection

Sec. 13-309 Measurements.

Sec. 13-313 Nuisance
and Inoperable Vehicles prohibited on public streets, alleys, or public parking
lots.
No person shall park, place, or leave any item or vehicle,
or store such item on a trailer on any public street, right-of-way, alley or
public parking lot owned and operated by the City that is defined as a public
nuisance in Section 10-601 (1-11) or defined as an inoperable vehicle in
Section 10-203(1).

Sec. 13-315 Residential parking permits.
A. Those vehicles displaying a parking permit
issued pursuant to this Section shall not be subject to the 2-hour time
limitations set forth in Section 13-311.
B. The holder of a parking permit issued under this
Section is not guaranteed a parking space.
C. A permit
issued pursuant to this section does not authorize parking in spaces reserved
for a specific purpose in Section 13-316 of this Article.
D. Upon application, non-transferable parking permits for the purpose of extended parking in 2-hour limited-time spaces shall be issued by the City Clerk for residents of the Central Business District. The City Clerk shall keep a written record of the name, address and dates of purchase/ expiration. Parking permits shall be issued for a period of twelve months. A fee of $25.00 for each permit is payable in advance at the utility payment window at City Hall. No more than 2 permits per residential address in the CBD area shall be in force. An individual issued a permit may cancel a parking permit at any time; however, no refunds will be issued for the unused period of the permit. It is the responsibility of the permit holder to renew such permit each year.
E. Parking
permits issued under this Section must be clearly displayed on the left side of
the rear bumper of any vehicle parked in an applicable designated parking
space, and must be maintained and kept clear of obstruction, in order to avoid
the penalties established by this Article.

Accessible parking spaces in the Central Business District shall be
appropriately marked according to the details set forth in the Americans with
Disabilities Act Accessibility Guidelines (ADAAG), and other guidelines that
may be applicable.

This requirement pertains to all public parking lots and marked on-street
parking areas.
E.
Any parking space appropriately designated, as “Accessible” parking in
accordance with guidelines at the federal, state, and local levels, is
enforceable as a traffic violation.
F.
Review and enforcement for maintenance of accessible parking spaces is
the responsibility of the City Manager or his/her designee, and includes
monitoring and adjusting the number of spaces, ensuring proper signage is
maintained, etc.

Sec. 13-321 Penalty for violation of article.
Violation
of any of the provisions of this article shall be deemed as a Class C
Misdemeanor.
The
penalty for violation of Section 13-301 shall be no less than ten dollars
($10.00). The penalty for violation of
Sections 13-311 and 13-312 shall be no less than five dollars ($5.00) and no
more than twenty-five dollars ($25.00).

ARTICLE
IV. OBSTRUCTIONS/TRAFFIC HAZARDS
Sec. 13-400 Removal of Traffic Hazards.
1. Removal of Traffic
Hazards.
In all areas on public or private property at any
corner formed by intersecting public streets, it shall be unlawful to create a
traffic hazard by installing, setting out or maintaining or allowing the
installation, setting out or maintenance of any sign, fence, hedge, shrubbery,
natural growth or other obstruction to view, or the parking of any vehicle
within that triangle formed as hereby described, such areas to be described as
sight triangles:
(a) Uncontrolled Intersections –
(b) Uncontrolled Intersections – Local to
Collector/Arterial: A sight triangle is the triangular area formed by the
intersection of two streets bound by two lines extending from the point of
intersection along the edge of traveled way for a distance 50 feet on the local
street and 60 feet on the collector or arterial street.
(c) Controlled Intersections – Partial Traffic
Signalization/Signage: A sight triangle is the triangular area formed by the
intersection of two streets bound by two lines extending from the point of
intersection along the edge of traveled way for a distance of 25 feet on the
street with the stop sign and 60 feet on the street with no traffic signage.
(d) Controlled Intersections – Full Traffic Signalization
or 4 Way Stop Signs: A sight triangle is the triangular area
formed by the intersection of two streets bound by two lines extending from the
point of intersection along the edge of traveled way for a distance of 25 feet.
2. Exceptions.
The
provisions of sight triangle shall not apply to those shrubs or bushes located
within a designated sight triangle, the maximum height of which is less than 3
feet (36 inches) measured from the established street level. For trees located within a sight triangle, a
minimum height clearance for limbs and relative growth shall be trimmed for
clearance of 8 feet from the established street level. Utility poles and equipment required for
traffic control shall be exempt from this section's restrictions.
3. Notice.
When
the Planning and Codes Administration Department determines upon the basis of a
sight triangle investigation that such a traffic hazard exists, it shall notify
the owner by certified mail and order that the hazard be removed within 10
days.
4. Removal;
Penalty.
The
failure of the owner to remove such a traffic hazard within 10 days shall
constitute an offense punishable by a penalty of $50. Every day said owner shall fail to remove the
hazard shall be a separate and distinct offense. If the traffic hazard has not been removed
within 10 days of the receipt of notice, the city shall remove the obstruction. A notice of costs shall be sent to the property
owner by certified mail. If payment of
costs is not received within 30 days after receipt of the invoice, the costs
shall be certified with the

If
any provision of this policy is declared unconstitutional, or the application
thereof to any person or circumstance is held invalid, the constitutionality of
the remainder of the policy and the applicability thereof to other persons and
circumstances shall not be affected.
