ARTICLE I.  CITY PARKS

 

Sec. 8-101                Names and locations of parks.

 

Parks shall be under the supervision of the City Manager.  The names and general locations of municipal parks in the city are:

 

A.            Forest Park, situated north of the Marais des Cygnes River and west of Locust Street;

 

B.                   College Park, also known as City Park, situated between Main Street and Hickory Street from a point 225 feet south of the south line of Fifth Street to the north line of Park Street;

 

C.                   Kanza Park, situated north of 15th Street, west of Santa Fe Railroad right-of-way, east of Gleason’s Addition, south of 11th Street.

 

D.                  Haley Park, situated at the southeast corner of the intersection of 2nd and Main Streets.

Sec. 8-102                Permission of Board of Commissioners necessary for certain uses; penalty.

 

A.            The Board of Commissioners, upon application being duly made therefore, shall permit such use to be made of park property and under such terms, provisions and restrictions as it shall deem expedient and in the best interests of the public, and it shall be unlawful for any person to occupy or use any of the structures within such parks or use such parks for meetings, assemblies, celebrations, public speaking or addresses, athletic contests, or ball games, or for any other special use or purpose, without first having secured the permission of the Board of Commissioners.

 

B.                A violation of this section is a Class B misdemeanor.

Sec. 8-103                Area limited for admission charges; penalty.

 

A.            Whenever permission has been secured from the Board of Commissioners for a use of park grounds for which an admission fee is to be charged, the right to charge admission shall be limited to the immediate vicinity of such attraction and shall not apply to the entrance gates of such parks.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-104                Unlawful to permit animals to trespass; penalty.

 

A.            It shall be unlawful for any person to drive or ride any animal upon the grounds of a park or to permit any animal owned or kept by him to trespass in or upon the grounds of such park; provided, that this section shall not apply to animals kept under restraint by use of a line or leash.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-105                Unlawful to molest birds or wild animals; penalty.

 

A.            It shall be unlawful for any person to kill, wound, catch, trap, net, ensnare or pursue with such intent any bird or wild animal within the parks or upon any of the streets adjacent thereto.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-106                Interference with bird or wild animal nests prohibited; penalty.

 

A.            It shall be unlawful for any person to destroy or remove from the nest of any bird any eggs or the young of such bird, or destroy or interfere with the nest of any bird or animal within the parks.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-107                Unlawful to climb trees or remove nuts; penalty.

 

A.            It shall be unlawful for any person to scale or climb any fence or tree within the City parks or to pick or remove nuts from any tree in such parks or to cast or throw clubs, stones or other missiles at, to or into the tops of such trees, or to pelt with poles, or with any other contrivance, any such trees or the tops or limbs of any such trees within such park.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-108                Littering of park with papers and rubbish prohibited; penalty.

 

A.                  It shall be unlawful for any person to throw or deposit any stick, stone, dirt, papers, rubbish, trash or garbage or other debris upon the grounds of City parks other than in receptacles maintained for the purpose of receiving the same.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-109                Restrictions on riding of motorcycles, mopeds and bicycles; penalty.

 

A.            It shall be unlawful for any person to ride a bicycle, motorcycle or moped upon paths for pedestrians within City parks unless such person, upon meeting any pedestrian, shall stop such bicycle, motorcycle or moped and dismount until such pedestrian has passed and such person shall not again mount such bicycle, motorcycle or moped until entirely past such pedestrian.

 

B.                A violation of this section is a Class C misdemeanor.

Sec. 8-110                Swimming Pool, use restrictions; penalty.

 

A.            It shall be unlawful for any person to be inside the fenced area of the Swimming Pool located at Forest Park or to be in the pool at any times other than those in which the pool is in operation unless permission is obtained from the Board of Commissioners.

 

B.                A violation of this section is a Class B misdemeanor.

Sec. 8-111                Skate Park, hours of operation.

 

A.                 It shall be lawful to be upon the premises of the City owned Skate Park during the following hours:  Monday-Saturday, 9:00 a.m.-9:00 p.m.; and, Sunday, 12 noon-9:00 p.m.  It shall be unlawful for any persons to enter or otherwise be upon the premises of the City owned Skate Park during any times other than those stated above.

 

B.                  It shall be unlawful for any person to have in any way, a motorcycle, moped, or motorized vehicle upon the surface of, or any appurtenances to the Skate Park.

 

C.                  Any person upon such premises during unauthorized hours, or any person with a motorcycle, moped, or motorized vehicle inside the Skate Park shall be guilty of a Class C misdemeanor; provided however, authorized City personnel and/or Recreation personnel may enter the Skate Park during said hours of prohibition.

Sec. 8-112             Forest Park Tennis Courts, prohibiting bicycles, skates, skateboards, scooter, and/or any other wheeled vehicles.

 

A.                 It shall be unlawful to be upon the premises of the City owned Tennis Courts with any of the following:  bicycles, skates, roller blades, skateboards, or scooters.

 

B.                  It shall be unlawful for any person to have in anyway, a motorcycle, moped, or motorized vehicle upon the surface of, or any appurtenances to the Tennis Courts.

 

C.                  Any person upon said premises with any of the abovementioned apparatus or any other device, power-driven or otherwise, that might cause damage to the surface of the Tennis Courts shall be guilty of a Class C misdemeanor.
